Private Company Settles SEC Charges for Violating Whistleblower Rules

Last week, the SEC settled charges against Nebraska-based Monolith Resources LLC, in connection with the company's use of employee separation agreements that precluded employees from receiving monetary whistleblower awards.

In its press release on the settlement, the SEC emphasized that whistleblower rules apply to public and private companies. The charges reflect the SEC's continued intent to enforce whistleblower rules, with 6 of the 10 largest whistleblower actions brought only in the last 3 years, including the largest ever action ($279 million) awarded earlier in 2023.

Any attempt to stifle or discourage communication with the SEC "will be dealt with appropriately."
